NMFS issues this final rule to implement management measures described in Amendment 35 to the Fishery Management Plan for the Reef Fish Resources of the Gulf of Mexico (FMP) prepared by the Gulf of Mexico Fishery Management Council (Council). This final rule establishes sector annual catch limits (ACLs) and sector annual catch targets (ACTs) for greater amberjack; revises the sector accountability measures (AMs) for greater amberjack; and establishes a commercial trip limit for greater amberjack. Additionally, Amendment 35 modifies the greater amberjack rebuilding plan. The intent of Amendment 35 is to end overfishing of greater amberjack, modify the greater amberjack rebuilding plan and help achieve optimum yield (OY) for the greater amberjack resource in accordance with the requirements of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act).

This rule is effective December 13, 2012.

NMFS issues this temporary rule to extend the expiration date of interim measures to reduce overfishing of gray triggerfish in the Gulf of Mexico (Gulf) implemented by a temporary rule published by NMFS on May 14, 2012. This temporary rule extends the reduced commercial quota (commercial annual catch target (ACT)), commercial and recreational annual catch limits (ACLs), and recreational ACT; and the revised recreational accountability measures (AMs) for gray triggerfish, as requested by the Gulf of Mexico Fishery Management Council (Council). The intended effect of this temporary rule is to reduce overfishing of the gray triggerfish resource in the Gulf while the Council develops permanent management measures.

BP and attorneys for businesses and people who lost money in the Gulf oil spill urged a federal judge to give his final approval to a class-action settlement.

U.S. District Judge Carl Barbier heard arguments from lawyers who negotiated the deal as well as other attorneys who have objected to parts of it. BP PLC estimates it will pay $7.8 billion to the resolve claims, but the settlement is not capped and BP could pay out more or less.

Barbier, who didn’t immediately rule, said the hearing was designed to help him determine if the settlement is “fair, reasonable and adequate” and that he doesn’t have the authority to rewrite or renegotiate it. Barbier said he would rule in the coming days. However, he said some of the objections he heard were “frankly, not made in good faith and bordered on being frivolous.”

The Florida Fish and Wildlife Conservation Commission (FWC) will be honoring Florida’s heroes on Veterans Day, Nov. 11, by implementing changes to commercial licensing requirements. The changes will make it easier for Florida veterans and veterans with disabilities to enter the commercial fishing industry.

The Deepwater Horizon trustees have released the Phase II Draft Early Restoration Plan & Environmental Review (DERP/ER) for public review and comment. The plan includes two proposed projects totaling about $9 million that focus on restoring nesting habitat for birds and sea turtles. Response efforts resulting from the Deepwater Horizon oil spill caused injuries to this natural habitat.

"This draft plan includes two Early Restoration projects which represent a near-term opportunity to improve the nesting habitats of birds and turtles, two species that are integral to the Gulf Coast wildlife community," said Cynthia Dohner, Natural Resource Trustee for the Department of the Interior. "Our desire is to provide these benefits during the next nesting season, but we'd first like to hear from the public. We encourage the public to attend the November 13 meeting in Pensacola and to give us their comments."

The SEDAR 28 assessment of the Gulf of Mexico Spanish mackerel and cobia fisheries will consist of a series of workshops and supplemental webinars. This notice is for a webinar associated with the Assessment portion of the SEDAR process.

The SEDAR 28 Assessment Workshop Webinar will be held on November 26, 2012, from 1 p.m. until 5 p.m. EDT. The established time may be adjusted as necessary to accommodate the timely completion of discussion relevant to the assessment process. Such adjustments may result in the meeting being extended from, or completed prior to, the times established by this notice.

The Gulf of Mexico Fishery Management Council met in Gulfport, Mississippi, October 29 - November 1, 2012, to discuss a number of fishery issues. Below is a summary of Council actions. 

On Oct. 1, the Florida Fish and Wildlife Conservation Commission (FWC) kicked off TrophyCatch to reward anglers for catching, documenting and voluntarily releasing trophy-sized bass in Florida. 

On the first day, Larry Campbell caught an 11.25-pound, 26.5-inch-long bass while fishing in the St. Johns River with his younger brother, using live shrimp. They had caught and released several 4- to 7-pound bass before Larry broke the 10-pound barrier for the first time in his 20 years of fishing. They found where they could boast online about their catch and posted it on TrophyCatchFlorida.com, an FWC website hosted by the World Fishing Network (WFN).
